Local Cape Town outfit FC Kapstadt are unhappy that the City of Cape Town and Cape Town City are trying to displace their club in favour of commercial interest.
FC Kapstadt, who are affiliated with the Cape Town Tygerberg FA, was established in 2002 and is currently based at Hartleyvale.
Kapstadt reveal that the City of Cape Town advertised the consideration for a Lease Agreement for Hartleyvale Stadium through local and community newspapers.
A statement from Kapstadt read,"In August 2017, the City of Cape Town through it's Property Management department advertised in local and community newspapers the consideration for a Lease Agreement for ERF'S at Hartleyvale Stadium Precinct and Malta Park Sports grounds.
FC Kapstadt is absolutely disgusted with the City of Cape Town's consideration for a proposed lease agreement for Cape Town City FC in the face of our existing rights.
Prior to advertising, the City of Cape Town and relevant departments failed to consult clubs.
In objecting to the City of Cape Town and Property Management, FC Kapstadt the current user of Hartleyvale Stadium A field and Hartleyvale D field and clubhouse, questioned the fairness of the lease application process.
Firstly, none of the existing users at Hartleyvale or Malta Park were consulted.
Secondly, the City of Cape Town and its relevant departments ignored the Rule of Law and showed scant respect for the existing rights of the current users.
Thirdly, the City of Cape Town ignored its agreement with FC Kapstadt reached in 2009 as part of its move from Greenpoint Common for the development of the Urban Park and Cape Town stadium.
Instead the COCT Property Management Department in a report tried to discredit users and FC Kapstadt of it's value as users at Hartleyvale and Malta Park.
Several objections to the proposed consideration for the lease agreement for CT City were logged from the Western Province Hockey Union (Hartleyvale Stadium), Silvertree Rugby Football Club (Malta Park A field), JMI FC (Malta Park B field) and All Stars Football Academy (Malta Park D field) and other.
None of the above-mentioned clubs were consulted regarding the consideration of the proposed lease agreement for CT City Sporting Club PTY LTD before placing the ERF's in a public newspapers advertisement.
In a Sub-Council 16 Hearing , the majority of the Ward Councilors voted in favor of the proposed lease agreement for CT City and ignored all the objections from clubs, facts and legalities pertaining to that of FC Kapstadt at Hartleyvale and Malta Park.
The Sub-Council 16 report for the proposed lease was irrational, irregular and reviewable, lacked sports facility management insight and again ignored the Rule of Law.
