The GladAfrica Championship had a dramatic final day of the 2020/21 season after Royal AM played to a 1-1 draw with Cape Town All Stars, while Sekhukhune United qualified for the play-offs with a 3-1 win over JDR Stars.
The results created confusion over who wins automatic promotion to the DStv Premiership due to a pending DC case. The final games of the GAC were overshadowed by the DC case involving Sekhukhune and Polokwane City which has not yet been finalised.
The Siya crew is in possession of the 19-page ruling which awards Sekhukhune three points, which is being contested by the PSL. The arbitration case could result in a change of log positions which in turn, could see Sekhukhune gain automatic promotion instead.
The PSL have challenged the decision by the SAFA arbitrator to award the Limpopo side three points, arguing that it would not be fair to give Sekhukhune three points due to Polokwane players having tested positive for Covid-19 during the country's second wave.
The League also argued that the DC failed to exercise its powers in terms of rule 57.13.16 but rather imposed a deduction of three points (in terms of 57.13.17) and a suspended fine or a fine or R100 000.
Another argument is that the DC could, in the circumstances, have followed rule 57.13.16 and sanctioned the respondent with a forfeit where this would amount to a loss of three goals to nil. And, that the DC should have acted, not only in terms of article 57.13.16, but also in terms of article 22 of the FIFA disciplinary code as referred above.
The League strongly believes that the sanction imposed by the DC should be set aside and instead Polokwane City be fined and no points awarded to Sekhukhune FC.
This in turn, would see Royal AM be crowned GAC champions and gain automatic promotion to the top flight.
